Abstract
This is the most important results which summarized as follows : The beholder to writings of those interested in the knowledge of the origins of jurisprudence , ancient and modern , will find an abvious scarce in the importance of this science , which represents the originality of Islamic thought , and to highlight the features in the sciences and other knowledge and its relationship with them , but will find most of these writings have poured in to the statement of his relationship with the science of jurisprudence and theology, logic , language, law and others. But I think that the parameters of the role of this science which did not address the people of the asset is clearly evident , but there were signs , is the relationship and its association with the media of the Islamic general and freedom of opinion in particular , and the authorization in this simple research , the role of open and close the excuses and pretension in at Islamic media and freedom of opinion . 1 . The Islamic media is not just religious sheets, and not limited radio programs, but it is the media which aims to provide people with trustd news , and views the right , so as to indicate the right and to promot the virtue among the people , and attend to achieve a number of objectives: Media purposefully non- biased , achieves the notification message being the fourth power which monitor and criticize and investigate the facts , and based on principles: credibility , honesty and transparency, difference , diversity and pluralism and impartiality , independence and moderation , and is mandated to : the defense of national issues , nationalism and national unification away from all forms of sectarian divisions and sectarian , ethnic , and expose , and modified affiliation about the concept of citizenship in a civil state , renounce violence and fighting , and the promotion of democracy and pluralism of opinion and respect the opinions of others , and defend of freedoms in all its forms , as all lead to imbalance in the social structure . 2 . The close and open out the pretensions properly, supported with the mind , and the aggressor of transport Sharia'a, and the case in due diligence , and it was unlike him , is due in fact to the facts based on it in the field of application , as well as that denied as an asset provisions, the demonstrated in the process of due diligence and practice Applied him , as the plyer can not cancel the sequences of acts not influence in judgement , as not prefer a preferable case on unpreferable case, and all that practical application of the substance to admit in close the pretensions. 3 . The medialist should realize that there are systems and limits which adjust its media work, which may be opened and not be closed: the result of pretext or media work there is must be prferable benefit, and not reach to the degree necessary or Haji, even if it means mixed with some prohibitions few and rare , as well as to pay greater damage sanctity pretension of itself, would act as open channels of Islamic satellite focuses on the element of fun legitimated , such as music , movies, project scientific and cultural entertaining selected , and where there is no broadcast of pretensions deviation or intellectual or moral . 4 .The Medialist is become to present works only useful beneficial , he has to know when to close the pretension and when open : Because the media may be a source of moral corruption , and it may also be a source of building moral ,so it is a machine broadcast, a pen ply , directed and edited , and to drive the media in order to be the best tools for the dissemination of Islamic ethics -Semitism , and replace the vice in which some people are immersed . 5 . I'v taken the definition of freedom of opinion in media : to be able both the individual and the people to express and disclose their opinions and ideas , and that is a statement of the right and the provision of advice in everything in order to achieve a public benefit , and safeguard the interests of both individual and society , without using the force or compulsion , but follow the orders Shar'i , through various media , print and audio- visual . 6 . The freedom of opinion in the Islamic media is not absolute , but constrained by ethical principles , and the legitimacy say is: the general interest of the community , and their controler is to close the pretension ,so Opinions and statements, some is available, and other is som is forbidden , and some are between,and the prevention is according to the lead the evils of interests and so swinging say or opinion that the interests of the jurisprudent say, or rule out the opinion that it preferable corrupts to the preferable benifit. 7 . The media in it's various institutions , especially the freedom of opinion can contribute directly in prevention of pretension of the corruption , various forms if stained in every opinion of their views , and in all ways and means, and in every function of their functions in the spirit of Islam and its directions , its principles, and its limits .
