Abstract
Electronic contract is the offer that raise from one of the party with the acceptance of another,aim to make contract by immediate communication methods , hearing (phone) or writing (telex) or by the copy as the original like transfer the picture by phone (Taccele). This contract is characterized by it found without not existing of parties or material contact , because most of it’s procedures be done with Internet from persons existing and belong to different states , electronic contracts is faced by different problems, one of that is the death of one party or capacity problems. When will is proved it’s effect in the contract it must be exist and represented and showing from adult and clear from defects that may be clear away or lack it so the contract may be false or stopping and that is represented from the problems that faced electronic contract
