| Abstract | ||
| تكتسب أهمية الوكالة بالخصومة من ناحيتين: الأولى : من الناحية الواقعية مهمة جداً لان التعامل بها شائع بين الناس في تصرفات كثيرة ، وتحتل جانبا َ مهما َ في ميدان القضاء وقد باتت فئة كبيرة من الناس تمتهن مهنة المحاماة. اما الثانية : فهي الناحية الاجتماعية اذ انها في الحقيقة مظهر من مظاهر التعاون المؤدي إلى إيجاد نوع ترابط بين افراد المجتمع اذ قد يكون مبعث التنازع تصور البعض ان الحق له وان لم يقصد غمط حق الغير، فيجر ذلك الى الخصومة حتى يظهر الحق امام القضاء . The importance of proxy of litigation is represented by two aspects the first one of which is that the real aspect as it is very important due to it is common deal among people in many behaviors and it is occupied an important part of the judgment so that considerable category of people practice advocacy while the second one is that the social aspect as to is a phenomena of cooperation leading to find a type of correlation among the person of the community so that it may an excitement of dispute by imagination of someone that he has the right if he does not mean controlling the others’ rights which leading to the litigation till evidencing the right before judgment. Plan of the Research and its sort: The research is consisted of two chapters : At first chapter we showed the rules of proxy of litigation in the Islamic Legalization and due to the comprehensive size of this matter we constrained on showing the important rules regarding the judicial proxy related with the right of advocacy before judgment. While at Second chapter , we showed the rules of proxy of litigation in Iraqi law. The researched was ended by the conclusions including the most important results. | ||
