Abstract
The facilities which is given by the system of global trade and commercial conventions leaded to the expand of trade activities across one country s for individuals and companies as well ,and it was expected the bankruptcy of most of companies and individuals for many reasons, as global continuous economic crises in most of countries, so the assets may be distributed in more than one country without depending on specific lawful provisions, hereupon the bankruptcy becomes no more local but it became cross border bankruptcy. And because most of provisions of bankruptcy are local, that leaded to many problems which cannot be solved unless we analyze the legal rules concerned and study the possible solutions either those existed or searching for another solutions… This study tried to find some of legal solutions, through studying the role of international judicial rules in this issue, in both Iraqi and Jordanian law, in addition to the rules of cross-border bankruptcy law issued by UNCITRAL.
