| Abstract | ||
| It is the mercy of Allah Almighty that we must bring down a law that is valid for all times and places, including all aspects of human life, in terms of the provisions and legislations that guarantee the existence and continuity of this life by preventing harm and maintaining it from all that may disrupt the purpose of God's creation of man in the earth. Which is worship of God Almighty and the earth's architecture. The medical profession is concerned with a great purpose of Shari'ah, which is the preservation of the soul. It is considered a general human common purpose, no one disputes the importance and importance of this profession and the nobility of those who are responsible for it, regardless of their gender, religion and philosophy of human life. The objectives of the Islamic Shari'a law before being called for by the laws of the situation, but the steady development in the scientific and technological field and the associated inventions and discoveries were linked to the health of mankind if it is well exploited and all that made the person threatened in his safety if the controls are not established Which governs this responsibility and keeps abreast of developments. Despite the fact that the medical profession is a human profession in the first place, it is a complex and dangerous profession, in which the mistakes of human life may result in a mistake and may result in some errors of death. With the terrible development in science, medical errors that have become almost daily And has become the talk of newspapers sometimes and the corridors of the courts sometimes other, which made the issue of medical errors a community problem that is of particular importance to all groups of society and is no longer a professional problem confined within the medical cadres so it was necessary attention to all parties in the equation in the field of medical protection of development and medical progress to serve the human On the one hand, and the protection of the sick person from this development, especially from medical errors on the other, and this emphasizes the need to develop regulations and legislation to ensure the safety of the human and protect him from excesses of doctors and accountability for mistakes committed against the patient.
