| Abstract | ||
| Then, the Islamic law established the principles of infidelity with the download of the Qur'an. The prayer was given by God, may He be glorified and exalted, to Himself and exercised it, and the seat of His foundation. Then the people of science passed on to him generation after generation. The reality has proved day after day the lofty status of Islam. The life of the individual and the Muslim community according to the guidance of the Sharia and its rulings. The mourning is the statement of the ruling on the reality in charge of it, which is the work of the Mufti and the fatwa is issued by the Mufti. It is more likely that the shar'i ruling is the ruling on the acts of worshipers in general, without regard to a specific reality related to the ruling, such as saying that prayer, fasting, inviolability, alcohol, adultery and so on must be done. The fatwa is often related to the reality of what is the fatwa on that is the application of the rule of legitimacy on the reality, although sometimes comes one of them in the sense of the other, they are linked and the fatwa is valid only if the legitimacy is applicable to the reality correctly. It is clear here that the fatwa may enter or linked to several factors and therefore the fatwa be arranged on them and may occur if the Mufti in an incident that has met all of the factors in the legitimate ruling that applies to them and then comes another incident similar to them in the apparent but between them influential difference In fact the result of the absence of some factors or the existence of other factors Mufti legitimate ruling suitable for the new situation is naturally different to the first fatwa and this face and so on - what is detailed in this research, God willing - said who said the scholars of the change of opinion and the difference, times and places and conditions and intentions and change Returns | ||
