Abstract
The knowledge of inheritance, and the science of inheritance is a science known to the inheritor and who does not inherit and the amount of each leg, and the subject of inheritance, and the purpose of delivery of all the right of the left of the dead. First: The importance of the subject and the reasons for its selection: The knowledge of the obligatory of the most important sciences after knowledge of the pillars of religion, and urged the Prophet  on teaching and learning, said: : Learn the statutes and taught them people (). The scholars in the Islamic schools of thought, when they speak of inheritance, put in their books the Book of Obligations. Many of them have written them independently of books of jurisprudence. This began from the second century of emigration with the beginning of the codification of jurisprudential rulings. Second: My method of research: 1. I first copied the manuscript based on the version I had marked with (a). 2. I was keen to edit the sayings of the jurists from their approved books, which are considered a reference in the editing of their doctrine in the late ones, and I did not transfer from the books of a particular doctrine the doctrine of others or vice versa, seeking accuracy in the proportion of statements and the liberation of doctrines. 3. Then I met her with the copy that I had marked B with the difference between the two copies and checked what is missing in the original copy. 4. I have graduated verses and Hadiths and monuments. Graduation of the texts in the research: (A) Qur'anic verses: 1 - Committed to distinguish the verses in the line of the Koran Madinah and the verse surrounded by two archers Azharin (). 2 - The verses attributed to the citizen of the book of God, and by mentioning the name of the Koran and the verse. (B) Hadiths and archeology: I committed myself to writing the hadiths mentioned in the text of the research, and surrounded by two quotation marks (...). In the Antiquities, I was satisfied with such quotation marks, which made it a difference between them. (2) The meaning of the ahaadeeth and the effects that were mentioned in the research are in the books of the year in which they were presented, and they are made in brackets. If the hadeeth is narrated in al-Saheehayn or in one of them, And the acceptance of the nation for them, and that the two of them goes to strengthen in addition to anything else, but I have proven the word Muslim in some of the ahaadeeth for the intensity of the maintenance of the words of the Prophet. If the hadeeth is in other Sunan, and it is attributed to the one who comes out of the four Sunnahs and others. 3. When mentioning the Hadith or the impact, mention the name of the book and the section in which the hadeeth was narrated, and the number of the hadeeth with the section and the page; because it is more meaningful in the meaning of his home, due to the different versions and multiplicity. (C) Juristic terms and foreign words: I showed their meanings and knew them through the books that I meant on this side. Third: Research Plan: The research study necessitated that I divide it in terms of formality on two subjects. The first topic is the study section, which deals with the life of the sheikh, the subject of the estate, and the definition of the manuscript on three demands. The first requirement was the definition of the aesthetic Sheikh and the research topic. Third: Sheikh Al-Jamali curriculum in the manuscript. As for the second topic: it dealt with the definition of the estate and there are two demands: the first requirement: the legacy language and terminology, the second requirement: the provisions related to it. In the second section, the Department of Investigation, where the Sheikh divided the subject of the search on seven sections sequentially according to the importance of the subject, namely: door assumptions and owners, and the door of the gangs, and the door of the womb, and the door of barriers and blocking, and the door Molly, and the door of the penitent, and divide the estate, On clear and clear chapters. Fourth: Since the manuscript has reached twelve plates, we have divided it into two sections. Each researcher has taken us to a section to suit the requirements of publishing scientific research in magazines, which is limited to 30 pages or less.
