| Abstract | ||
| The issue of dismissal is one of the most important issues that a person needs in his career, such as his need for a contract of sale, and other civil contracts in which daily life is valid. Some of us buy something or sell it and then refrain from buying or selling it. If the contract is canceled, the contract may not be terminated without the consent of the other party. I wanted to be a research topic within the research plan at the college marked B (dismissal in the sale between Sharia and law) and includes two sections: The first topic: Definition of dismissal and the position of Sharia and the law of it and it has three demands: First requirement: Definition of dismissal The second requirement: the position of the people of the Sharia from the retroactive effect of dismissal. Third requirement: the position of the people of the law of the retroactive effect of dismissal. The second topic: Affected by the dismissal of the conditions of the jurists and the people of the law is on two demands: The first requirement: The dismissal was influenced by the conditions of the fuqaha ' The second requirement: The dismissal is affected by the conditions of the people of the law Then the conclusion, so that the picture is clear to those who want to recognize the dismissal and its reactionary reaction asking the Lord Almighty to benefit and benefit by me and other students of science | ||
