| Abstract | ||
| Mitigation Performed by the Creditor Studies dealing with “compensation” have taken a great deal of legal scholars’ consideration. Although, these studies did not shed the light on the necessity for creditor to interfere in order to alleviate the damages occurred by the debtor due to breaching the contract. It is also worthy to mention, that some laws have implicitly adopted this concept for its positive inpact in order to achieve justice between the contracting parties, and also so that the debtor who breached the contract would not be influenced by the creditor who can alleviate the damage by taking reasonable measures. | ||
