Abstract
The imprisonment is one of the means of criminal punishment for criminals and perpetrators from ancient times to the present day. The place where these criminals are placed is called the prison, and there are references to the mention of the prison in the Koran and the Prophet's Hadith. In the era of the Prophet, the place where the person is placed and prevents himself from acting, and the aim is not to harm the person or to detain him in a confined place and to prevent him from water and eating. The detention in the mosque or in the house or tents And continued on this case to the reign of the Caliph Abu Bakr (). And after the expansion of the Islamic state in the era of Caliph Omar ibn al-Khattab (), and increase the number of Muslims through which the growing numbers of social problems and personal issues, which called for the need to find a place for violators to implement the penal sanctions against them, and took a house close to the Prophet's Mosque to be the first place To imprisonment in Islam.
