| Abstract This research is trying to answer of the important question is : "Is that the crimes that occurred in Karbala on the tenth of Muharram 61 AH, live as genocide and crimes against humanity? Is it permissible to criminalize the perpetrators after more than thirteen centuries ?", Through the legal presentation of the texts legal contained in international humanitarian law and application on crimes committed in the incident tuff in 61 AH, and an attempt to criminalize the perpetrators in accordance with the crimes contained in the above law, especially crimes of genocide and crimes against humanity, with a statement of the legal adaptation depending on the legal texts and historical sources, who Reported these Crimes | ||
