Abstract
The importance of choosing the research is identify the legal procedure by which the old Iraqi legislator tried and more than four thousand years to preserve the family entity as the basic building of the society and the accountability of the members, including those directly responsible for it). in the case of violation of the unity or override the sanctity or act in an irrational manner leads to the demolition of the family building , at a time when the current European and western laws claim to have precedence in the development of legal rules that will protect the family and society . what is stated in the law of Hammurabi and the laws that preceded it proves beyond any doubt that the ancient Iraqis were the pioneers in laying the legal foundation for protection of the family and its organization more than four thousand years from now. In order to achieve this goal and to preserve the family entity , it was necessary to put in place the deterrent punishments that would reduce domestic violence and seek the relation of the individuals to the best of both the family and the community .in order to get acquainted with this important subject, we decided that the research should include several axes and paragraph in which we discussed the definition of family violence in the term of language and terminology, a brief description of the structure of the old Iraqi family , and the reasons and the form of domestic violence and criminal responsibility toward it .the research explored methods that would be a factor in reducing domestic violence.
