| Abstract The effects of the issue of the state in Islam is a lot of interest among those involved in the subjects of state, politics and governance in Islam. But also attracted others from non-specialists in the subject in view of the importance of the subject stemming from the importance of Islam and its status among Muslims in general and the reform movements derived from their visions and approaches and starting from it. Especially after the expansion of the Islamic awakening blessed at all levels and cut in the footsteps of her auspicious path. Despite the large number of literature that dealt with the subjects of the state in Islam, vast areas of the theories of the state and its investigations still need contemporary treatment. Therefore, this study comes to examine the concept of the state, its elements and its characteristics, and the basis of its legitimacy. What distinguishes it from other studies is that it deals with the subject in a comparative way with the current positive legal thought and in a legal language that seeks to represent the Islamic data in the theories of the state and the systems of governance in a contemporary legal manner, thus contributing to highlighting the specificity of the Islamic proposition in this regard compared to contemporary legal thought. As we have tried in this study to fill the opinions of contemporary dissenters of the Islamists in relation to the subject of research and exit opinion in it. | ||
