| Abstract: This research aims to root the inference with the jurisprudential rule, showing its controls, and highlighting samples of its most important contemporary applications. Some approaches were adopted, the most important of which include the inductive approach and the comparative approach. The most important results thereof include: the jurisprudential rules are based on the majority rather than the whole people. They are a pretext, that is to say that they are valid to be inferred with in the calamities of each era under controls including research, noting that the jurisprudential rules, although they are a pretext, are not of the same degree in that. Many contemporary scholars inferred with the jurisprudence rules to determine the rulings on contemporary calamities and the research included some of these inferences. The researcher recommends further studies and conferences on the aspects of the research subject, which did not have a sufficient research and study.
