Abstract
In the beginning of his introduction of research, Hammadi Dweib wanted to link the origins of jurisprudence with its historical and social realities in an approach to prove that the fundamentalist system is influenced by historical reality. The researcher mentioned in the beginning of his research that he relied on the historical approach to prove this correlation at the time between the researcher Fahd al-Hammoudi that the researcher relied on orientalist approach Gold Zeher and Shakht to highlight the approach. The researcher Meriem Attia analyzed the researcher's views and criticism and revealed many of the methodological fallacies that he wanted to direct to the assets that Al-Shafi'i had, which were not his invention, but were used by the Sahaabah in their fatwas and jurisprudence enough to indicate that the stage of codification Shafi'i has nothing to do with the formation of assets. The researcher also raised several questions on some of the assets dealt with by the researcher trying to answer them through the folds of this article beginning with criticism of the historical approach, which can not be applied to the assets of jurisprudence and mental. The researcher also revealed the historical approach adopted by the researcher as a tool of modernity, which is intended to break with the principles of jurisprudence and revolution on the Muslims and the abolition of holiness on the origins of the Quran and the Prophetic Sunnah.
