Abstract
The Credit is the cornerstone basis d of the pillars of business, which is one of the factors that led to the distinctness and the independence of the Commercial Code, and the causes of the credit -that longer is logical consequence has widened immunity commercial disposal, which is surrounded by filling impervious against what could threaten its existence and of his being, and thus achieve credit. And Immunity -in Jurists- represent the most important features of commercial law, depending on the Titles that qualify them, this difference of names, which was accompanied by different foundations put forward to justify this immunity, if we see that it's immune-based solidarity, with a note, that if solidarity is not presumed, it is not meaningful so it is required to be frank, because it can be utilized by implication from the nature of the circumstances, even though we tend to make solidarity in commercial law is the parent-namely supposed-. However, it must pay attention to these immune her what than mitigated, and kept up with indefinitely lead to results contrary to justice, with an emphasis on the means of mitigation is not an exception to immunity as far as application of the general rules of action or civil liability.
