| Abstract | ||
| Article 38 of the Statute for each of the Permanent Court of International Justice and the International Court of Justice and Article 21 of the International Criminal Court Stipulated for the general principles of law as well as international treaties and international custom as a source shall apply by the court to decide such disputes as are submitted to it. In this paper we show the point of view of scholars in the concept , content and the context of these principles as well as its legal nature in the first section. Then we deal the judicial applications of these principles in the second section. In the conclusion we show the most important results and our point of view in the questions posed by the search.
