| Abstract | ||
| The custom known as an important assets in the Islamic legislation ,so in fiqih , they belonged to it so many matters especially in department of transaction. It is the source in explantory and making clear the ambiguous of the rules wich they have not any attach neither in legally nor in language.So this search has deal with the impact of custom in declaration of rules and what must they have to get it is effects in the rule especially what it has gone of the haziness unclear between the to contractors when they about to sign their contract. And this search spotlight on some of the Fiqih application in which the custom has it is impact in removing the obscurity that this application has got which my be lead to disputation between the to contractors. | ||
