Abstract
Aimed at this study to the statement of the real objectives of the Organization of the state of emergency and the role of the judicial supervision of its work, it was divided into An Anthology Two. Contained the first grade and to give the concept of the state of emergency and doctrine and jurisprudence of the definition of this system, and it was clear that the definition of the system as well as the legal nature of the decision of the declaration of a state of emergency not agreed and jurisprudence and spend, but that the measures and actions to be taken in accordance with the Declaration are considered administrative decisions in the same way as it applies to the other administrative decisions of the extension of judicial oversight. The Grade II addressed the role of the judiciary in the annulment of unlawful emergency authority, through the control of juvenile justice of legitimacy, the cancellation of the internal and external resolutions of the emergency authority, and reached to as a result of this the system under the control of the judiciary in the annulment of administrative decisions and unlawful emergency powers.
