Abstract
The International Commercial Arbitration born in the international trading environment, where it originated and evolved under the pressure of business needs, and practical imperatives that necessitated finding a way to resolve trade disputes that occur on the occasion of a particular type of business (an international business), those businesses that are not bounded by borders integrity of States does not prevent of existence distances and different places, but can 't be an international judicial body in Iraq issued decisions and judgments binding arising from international trade deal in accordance with the uniform and consistent legal rules of disputes, it has required the presence of legal regulation on the one hand, a judicial alternative system, on the other hand, addresses discounts and solve disputes arising from international commercial transactions that meet the needs of traders, and fit multiple international trading systems, which necessitated the adoption of international commercial arbitration system, which is consistent with the requirements of trade and the interests of the dealers at the international and internal levels.
