Abstract
There is no doubt that Islamic law is the law fit every time and place and event, and the changing circumstances years divine, and changing conditions is the Insolvency and Alaasar, took into account the Islamic law of this case, however, were provisions there are solutions for those afflicted to insolvency, and duties of the many people must be performed from spending The wife and children, mother and others. One of those who God has enjoined on man to spend it the wife, if left-handed pair for alimony to his wife, a need for this expenditure, is entitled to refer the matter to the judge to distinguish between them and her husband insolvent? This is what I am dealing with in my research that I called (the rule of distinction between the couple to the insolvency of the husband in Islamic law). One of the main reasons that I was invited to write on this subject is what our country is going through wounded occupant of the crises at all levels, and in particular economic crises. With the spread of unemployment, high prices, lack of working men have suffered a lot of hardship and distress and destitution. Prompting some women to complain, and raised some issues in the courts against their husbands are demanding secession from them.
