| Abstract | ||
| In the present paper, the researcher has examined the jurisprudential view concerning the wergild (payment upon sustained injury or loss of organs and senses) discussing each and every opinion. Then, he presented the most preponderant one. The researcher tackles and elucidates the meaning of wergild, the terms of payment in the time of prophet Mohammad (Allah Peace And Blessing Be On Him)and his companions (May Allah Be Pleased With Them)as well as the views that jurisprudents and scholars have unanimously agreed upon. Results : 1. Wergild is a legitimate right for each and every adult Muslim; it is a kind of compensation for the loss of a particular organ or injury, intentional or unintentional. 2. Wergild is a reciprocal punishment or payment that recompenses for killing chastisement. 3. Causing injuries is strictly forbidden because of being an assault on human soul. 4. The significance and the purpose behind paying wergild is to prevent man from committing crimes. 5. The offender must pay wergild as a punishment for causing injuries or killing. | ||
