Abstract
This study sheds light on the discretionary power of the judge in compelling the husband to provide for the wife after he refrained from doing so in Islamic jurisprudence. It compares the position of Islamic jurisprudence with the laws of the Gulf Cooperation Council countries. It aims to clarify the concept of maintenance in Islamic jurisprudence and the law, its ruling. This is in addition to the ruling regarding the husband's refusal, the discretionary power of the judge in dealing with a husband who is financially capable if he refused to provide the maintenance for his wife, and the position of personal laws in the Gulf Cooperation Council countries in assessing the wife's maintenance in case the husband refrains from providing it.
