| Abstract | ||
| This study examines the liability of operators and third parties for damages resulting from aviation accidents in accordance with international agreements such as the Montreal Convention of 2009 and the Rome Convention of 1952. The aim of the study is to define the status of “aircraft in flight” in accordance with legal definitions and to provide applied mechanisms for effective provision of compensation. . The results of the study indicate the necessity of determining the specific period for the flight case and focusing on ensuring fair compensation for the affected parties, in a way that achieves compatibility with international standards, and highlights the importance of information exchange and international cooperation in managing air accidents and resulting disputes, and the necessity of updating local legislation to provide an appropriate legal environment for the application of international conventions. And protecting the rights of those affected. International efforts to regulate the responsibility of the aircraft operator for damage caused by aircraft to others on the surface of the Earth began in 1930 AD, and based on these efforts, the Rome Convention of 1933 AD was concluded, which was amended pursuant to the Brussels Protocol, which did not enter into force.
