Abstract
Sale and purchase contracts and other legal contracts are important in daily life, as they represent the basis of the contractual relationship between individuals and institutions. In order to determine the nature of these contracts and to define the rights and duties arising from them, the justifications play an important role, as the justifications for determining the nature of the contracts include several aspects, Among them are the specialized justifications that are based on the expert’s specialization in this field and his ability to analyze the situation and evaluate the actual conditions of the contract, in addition to the scientific justifications that depend on scientific knowledge and legal theories. Similarities, while the justifications for the types of commercial and civil contracts focus on the differences in the nature of these contracts, which can affect the determination of the rights and duties arising therefrom. Thus, it can be said that determining the nature of contracts depends on a number of justifications that include many legal, specialized and scientific aspects, and specialists in this field must rely on these justifications in analyzing contracts and determining the rights and duties arising from them.
