| Abstract | ||
| Through this research , we addressed the theme of disability that prevent the possibility of a formal disposition and shows us that man when he is opposed by symptoms that are contrary to his will can prevent his ability to complete the formal legal disposition in which the legal project entails the imposition of Bending of certain structural this is not a disposition intact until after they meet , and since the nature of human life and sustainability does not stop at opposed occurred to humans , it is not fair nor logical in legal sense not to dwell on the disable conclusion of the formal disposition here promote the need to reconcile what holds a person of disability by this and on the other side , we find the legislator had been placed walls of structural regulations , which of course did not put legislator arbitrarily , and in spite of addressing the legislative system of the subject and although the FIGH has said his speech as well , but we however regretfully touched legislative gap features especially after the different applications and assumptions that have emerged especially after the precursors that gripped human societies , whether inside or outside of Iraq , But the FIGH remains between the push and pull of theorizations differentiated from penetrating in the format requirements and those who look at the emergence of theories capable of covering the various hypotheses of the topic . | ||
