Abstract
Over the years, the Iraqi state witnessed multiple governance experiments, as these experiments were based on the concepts of centralization and decentralization in administration (even if they were not true). In the period following 2003, the Iraqi state also witnessed the emergence of administrative and political decentralization, not only at the level of the constitutional and legal text, but also within the framework of Practical application of these concepts. Through this study, we are trying to shed light on the foundations upon which the Iraqi Constitution of 2005 was based in organizing local decentralization, clarify the nature of the powers granted to it, and highlight the most prominent gaps and problems related to this organization. The problem under investigation lies in the extent of knowledge of the foundations upon which the Iraqi constitution was based and how it dealt with the issue of the distribution of powers within the federal state, through the texts of the constitution under investigation, expressing an opinion on them, drawing attention to the existence of conflict between them, and the extent of their compatibility with the principles governing the federal system and the parliamentary system, and other issues that require the nature of their treatment.
