The development of financing activity within society has become remarkable in the way that most countries regulate laws in order to employ them to serve economic development. From this point, the idea of this research, in which we will explain, was, first of all, to shed light on consumer financing, considering it a contract like all other contracts, as we will clarify its definition and Then explain its properties, by identifying its types and legal nature, we will then explain the concept of companies carrying out this activity in terms of their definition, how they are established, and the effects of this contract by explaining the obligations and rights of the parties and monitoring the work of these companies. We also note that the problem addressed by this research is the lack of legal regulation of the consumer finance contract and the companies operating in this field in Iraq, which made us turn to the experience of one of the Arab countries, represented by Egypt, in the field of regulating this contract in a law that addresses most of the joints of this contract, embodied in Law No. (18) of 2020, and benefiting from it in the event that the Iraqi legislator enacts a law to regulate this activity in the future. |
