| Abstract | ||
| the administrative authority in the field of smoking control enjoys the privileges of the public authority, including the administrative control authority. The administrative control bodies carry out their functions by intervening in several ways or means to protect the public health system: Regulatory decisions (regulations or instructions) and individual decisions, in addition to some individual control measures such as orders (mandation) and bans (prevention). They can also resort to direct and forced implementation of their decisions without obtaining approval from the judiciary. Even if these measures lead to limiting or restricting the rights of individuals and their public life, provided that the means taken by these authorities are based on the law, to ensure a balance between preserving the rights and freedoms of individuals and protecting public health in a way that does not conflict with maintaining public order, and all of this happens under judicial oversight to determine the legitimacy of the decisions taken. The role played by administrative control bodies in the field of maintaining the public health system is of great importance, as reality requires real treatments as a result of the spread of the phenomenon of smoking among different age groups despite its deadly health effects, identifying the causes and social factors that encourage smoking, and clarifying the control measures to prevent and reduce smoking. | ||
