Abstract
In this study, we focus on the issue of promoting the right to digital privacy within the challenges of the digital age, technological development and the acceleration of the pace of development, although it has enabled people to use digital information and communication technology, at the same time it has strengthened the ability of people and governments to violate the right to privacy, which is one of the basic and democratic principles of most constitutions in the world. The use of modern technology such as the Internet and artificial intelligence has led to the emergence of new risks related to the collection and use of personal data and focus on the challenges facing the application of traditional laws in light of the digital environment, digital crimes and civil liability for violating privacy Despite the many benefits that the digital world has helped in, the challenges it has raised are great, including those related to the protection of personal information, ensuring data security, and addressing the effects of data control for both the Hub and the bear, including the role of governments to develop a mechanism for the exercise of surveillance using advanced programs. Where most legislations have shown that they are unable to confront violations of digital data and information for the possibility of people developing in this aspect or science as a right to education. We look at the adequacy of laws to deal with violations of digital privacy, especially the Iraqi Civil Code.
