The role of the rules of public international law in determining the relationship between the refugee and the country of asylum

Abstract
Throughout history, people have been forced to abandon their homes and seek safety elsewhere to escape persecution, armed conflict, and political violence. If we reflect on the various cases of asylum in the world, we will find that no person chooses to be a refugee of his own free will, but rather that the harsh conditions push him to leave his homeland in search of safety in another land, with all the risks and dangers that entail. A person may be compelled to flee and seek refuge due to persecution based on their color, ethnicity, social status, religious beliefs, allegiance to a particular group, or due to their intellectual and political stances. Consequently, it is evident that the phenomenon of asylum and refugees has been an integral part of human history since ancient times. Despite the participation of all humanity in the basic essence of the concept of asylum, its mechanisms for the embodiment of this concept have differed according to the different human cultures and civilizations throughout history. The Arabs before Islam, where their social and political system was based on the tribe, their concept of asylum was influenced by the customs and values of the tribe. After the spread of Islam, and with the systems and values that it brought based on the bond of Islamic brotherhood, the concept of refuge was changed, in a way that is compatible with the foundation on which this religion is based.
