Abstract
This research consisted first of the title, where we proceeded to detail the vocabulary of the research title, then a general summary of the research, after that a summary of the research topic, and after that an introduction in which we explained the importance of contracts in human life, then we began detailing the elements of the introduction in terms of identifying the research problem, its importance The research topic, the nature of the research topic, the research methodology, the research plan, and then we discussed the details of the plan’s topic, as the plan was divided into two sections and five demands. As for the first topic: it included the definition of the rule of need being lowered to the status of necessity, and this topic included two demands, the first: we explained through it What is need and necessity and the difference between them? As for The second requirement: It may include the words rule and integration that depend on jurisprudence to adopt the rule, and this is all that is included in the first topic. As for the second topic: it may include participation in financial contracts for this rule as a model for it, which is (the hawala contract), and it may include three demands. The first requirement: The definition of the transfer and its project, and the second requirement: through which we clarified the binding ruling and the jurisprudential adaptation of the transfer, and the third requirement: rooting the theory of the contract through the rule of need descending to a bright status, and this requirement is the one that was connected to the basis of the research as we decided on the basic specialization. To reach the foundation of the contract theory through this rule, then we concluded the research with a conclusion
