The effectiveness of International Humanitarian Law Rules in Protecting Missing Persons

As soon as war ends, it is accompanied by large numbers of missing persons, in addition to the feeling of anxiety and fear that accompanies their families and friends due to the uncertainty of the fate of their missing relatives. This leads to legal, administrative, social and economic difficulties related to knowing the fate of these missing persons and the way their families live after them. Furthermore, governments, military authorities and armed groups are obligated to provide information about missing persons and join efforts to reunite families. International humanitarian law also obliges parties to the conflict to take the necessary procedures to ensure that persons do not disappear in armed conflicts. Moreover, parties to the conflict must follow all possible steps to ensure that fate of those persons is known and inform their families about it as well as to protect their rights. Research on this topic requires us to divide it into two sections. In the first section, we explain the concept of missing persons in international humanitarian law, which is divided into three demands. Then, in the second section, we discuss the protection of missing persons and their families in international humanitarian law, which is divided into two demands.
