| Abstract | ||
| This research is devoted to studying the provisions of the destruction of the property in non-binding contracts, through defining non-binding contracts and stating the cases that lead to the creation of this type of contracts, as well as bringing contracts that have a non-binding nature, then after that stating the provisions of the destruction of each case that leads to non-binding contracts by stating contracts that create described obligations, such as contracts associated with the option of condition and the resolutory term, as well as contracts that create optional obligations and alternative obligations. Also through the named non-binding contracts, by stating the ruling of the destruction of the property in the loan and deposit, then the contracts of possessory mortgage and loan, concluding what this research has reached with what these legislative texts have established and stating the cases of legislative shortcomings in them, and reaching the appropriate recommendations to develop Iraqi civil legislation regarding the cases of destruction in it. This research is divided into an introduction, two sections, and a conclusion. In the first section, we explain the provisions of the destruction of the property in contracts that create described obligations. It is in turn divided into two requirements: . The second section is entitled the provisions of the destruction of the property in non-binding named contracts. It is also in turn divided into two requirements: The conclusion includes the conclusions and suggestions in it. | ||
