Abstract
The predominance of moral tendency of criminal liabilities rules, it’s obstacles, flexibility of it is concept considering it us measurable negative roles. expansion in it is interpretation as far as related to the general framework of it is private legal module from one side. and expanding the meaning of psychological disorders and their application to the criminal field. especially after it is with spread in our contemporary society from other side. this research Amit to identify the mentally disordered person through clarifying mental disordered and it is types, in addition distinguishing it from mental disorders, and clarifying its medical provisions, it's development, and the extent to which criminal legislations complies with it, in order to identify its impact on the elements of criminal liability of the affected person and his responsibility for the committed crimes by the person why you being under such psychological disorder. in this research we have reached several conclusions most importantly, the Iraqi legislator in the criminal code did not complies with what her being achieved by mental and psychological Medical Science in identifying, the psychological disorders and it is distinguish from mental disorders, and the problems are voices from meat in implementing panel rules related to contraindications Criminal liability. Based on that we have recommended for the Iraqi legislator to comply with the progress achieved in the field of mental and psychological medicine similar to comparative legislations more specially the Egyptian legislator.
