Abstract
The research aimed to study the constitutional contribution to the consecration and protection of the right to social security in the Iraqi Constitution of 2005, and to demonstrate the adequacy of constitutional texts in ensuring the application of this right and protecting it from any violations or abuses. It also sheds light on the role of the principle of legitimacy and separation of powers in strengthening this right, with a focus on the judicial and constitutional guarantees granted to achieve social justice. The research followed the descriptive analytical approach, as it relied on analyzing the relevant constitutional and legislative texts, and deducing the extent of their effectiveness in protecting the right to social security, in addition to using the comparative approach when necessary to compare the Iraqi experience with other constitutions. The research reached several results, the most important of which is that the Iraqi Constitution of 2005 guaranteed the right to social security as one of the basic rights, but there is a clear gap between the constitutional texts and practical application, which requires detailed legislation to ensure the implementation of this right. The research also emphasized the importance of constitutional judiciary as a primary guarantee for protecting this right through monitoring the constitutionality of laws.
