| Abstract | ||
| On 19/7/2024, the International Court of Justice issued its advisory opinion - based on the request of the United Nations General Assembly dated 31/12/2022 - regarding the Israeli occupation of the Palestinian territories, as it considered it a violation of international law, and consistent with Security Council Resolution No. (242) issued on 22 November 1967, which calls for withdrawal to the borders before the 1967 war. This advisory opinion is a new affirmative position condemning the Israeli entity for its occupation of the Palestinian territories. Although this opinion is advisory, it may have a significant and effective impact on international public opinion and negatively affect the relations of the Israeli entity with the international community. The aim of this study is to clarify the position of international law based on the advisory opinion submitted by the International Court of Justice regarding the Israeli occupation of the Palestinian territories after 1967, the international community's reaction to the aforementioned decision, and how to compel Israel to implement it. This study poses the following questions: What is the impact of the advisory opinion on Israel? What is the impact of the advisory opinion on the establishment of the State of Palestine? To what extent is the advisory opinion of the International Court of Justice binding and enforceable by the international community? | ||
