| Abstract | ||
| The Federal Supreme Court's jurisdictional orders are a basic legal pillar used to effectively implement judicial rulings and decisions, as these orders are issued by the Federal Supreme Court and are binding on the relevant authorities to implement them. The jurisdictional orders are among the procedural issues of importance within the scope of constitutional justice that the Iraqi legislator did not regulate in the Federal Supreme Court Law No. (30) of 2005, amended by Law No. (25) of 2021, nor in its internal regulations No. (1) of 2022. Rather, it referred the matter to the Civil Procedure Law No. (83) of 1969, as amended. The Federal Court exercises jurisdictional jurisdiction by considering requests to issue jurisdictional orders, as they are one of the means authorized by the Iraqi legislator to preserve rights and legal positions. They are an important tool for effectively implementing judicial rulings and decisions and contribute to protecting the rights of individuals and society by ensuring the fair and equitable implementation of judicial rulings. They are an important tool for strengthening the rule of law and ensuring respect for the judicial system. Judicial orders must be based on sound legal foundations, consistent with applicable laws and legislation, necessary for the implementation of judicial rulings and decisions, and proportionate to their purpose. These orders are used to implement civil rulings, such as rulings related to debts or contracts, and criminal rulings, such as rulings related to custodial sentences. | ||
