Abstract
Objectives: This research addresses a precise foundational issue related to how jurists handle the meanings of general terms. It examines a question posed by al-Taftazani in his work Sharh al-Talwih concerning the restriction of a general term to some of its instances and the implications this has for the affirmation or negation of the concept of mukhalafa (the concept of logical opposition),The research adopts an analytical and foundational approach, beginning with the verification of the question and its answer, clarifying their intended meanings, and then connecting the issue to its foundational roots in the chapter on the meaning of general terms and the concept of mukhalafa. The study includes a review of the opinions of both the Hanafi scholars and the majority, discussing the evidence they relied uponk,The aim of the research is to clarify the precise dialectical methodology followed by al-Taftazani and how he resolves issues that might suggest a contradiction between verbal rules. It also seeks to highlight the relationship between the restriction of the general term and the concept of mukhalafa, in terms of semantic structure and legal impact, The research concludes that this issue represents a profound model of the integration of legal principles and highlights the need for applied studies of major foundational texts—such as Sharh al-Talwih—which can reveal their nuanced details and precision.
