| Abstract | ||
| This research addresses the phenomenon of digital drugs as one of the emerging crimes resulting from rapid technological development. It highlights the serious social, psychological, and health consequences of digital drugs, particularly for youth and children. The study examines the theoretical legal elements of this crime, discusses the potential criminal liability of users and promoters, and analyzes the legal challenges arising from the absence of explicit provisions in Iraqi legislation. It concludes with the urgent need to close this legislative gap by establishing a clear legal framework for criminalizing digital drugs in Iraq, drawing upon comparative insights from Jordanian and Egyptian legislation, as well as relevant international and regional recommendations. Given the importance of the topic and its negative effects on society and individuals alike, on the one hand, and on the other hand the existence of legislative shortcomings in national law and comparative laws alike, it was necessary for us to adopt more than one research method. Our method was descriptive, analytical, and comparative, to describe what is meant by digital drugs and to analyze the traditional legal texts related to the Penal Code and the Anti-Drug Law to determine the extent of their applicability to this type of emerging crime, in addition to comparing them with some comparative laws. | ||
