Abstract
With the expansion of large industrial companies, they became unable to distribute their products themselves. Therefore, they resorted to using commercial agents to perform this role on their behalf in exchange for a commission. For the agent to do so legally, they must be granted a commercial agency license. However, this requires meeting a set of controls and conditions. Failure to meet any of these conditions results in the revocation of the license, as part of the state's oversight of its activities, which extends beyond the initial licensing stage. The scope of our study will be about granting a commercial agency license in the event that the prescribed conditions are met and the cases of its cancellation in accordance with the provisions of the Iraqi Commercial Agency Regulation Law No. 79 of 2017 in force and the Egyptian Commercial Agency and Some Commercial Brokerage Regulation Law No. 120 of 1982 in force, as amended by Law No. 21 of 2022. In our study, we adopted the analytical approach by analyzing the texts of the Iraqi Commercial Agency Regulation Law No. 79 of 2017, which is in force, and the comparative approach by comparing the provisions of this law with the Egyptian Commercial Agency Regulation Law No. 120 of 1982, amended by Law No. 21 of 2022.
