| Abstract | ||
| The legal system in the digital age is undergoing profound transformations as a result of rapid technological advancements, with digital evidence emerging as a fundamental component of judicial proof. This type of evidence encompasses a wide range of data produced, stored, or transmitted through electronic media, ranging from emails and text messages to the complex outputs of artificial intelligence systems. This new reality has reshaped the concept of legal proof, which is no longer confined to traditional means but now requires a comprehensive legal and technical framework capable of accommodating the nature of digital evidence and ensuring its effectiveness in court. While technology offers unprecedented opportunities to document facts with accuracy and objectivity, it simultaneously raises critical challenges regarding the admissibility of digital evidence, its technical reliability, and its protection against manipulation, in addition to issues of privacy and legal responsibility associated with its use. These challenges become even more pronounced with the growing reliance on artificial intelligence, which introduces new questions about the extent to which its outputs can be accepted as judicial evidence and whether they possess sufficient credibility and neutrality. This research aims to provide a comprehensive analytical perspective on the role of digital evidence within the modern judicial system, highlighting the urgent need to develop a balanced legal framework that embraces technological transformations while safeguarding fundamental rights and freedoms. Such a framework would reinforce trust in justice in the era of digital transformation. | ||
