| Abstract | ||
| This research addresses the issue of voter bias from a legal perspective. We have identified a set of violations that lead to bias. These violations range from cases of bias during the nomination period, such as the crime of threatening and using force against voters or specific candidates, including preventing them from exercising their right to campaign, to the exploitation of public funds and sovereign positions, and the use of public facilities for campaigning. They also include cases of bias through parliamentary activity, such as the expiration of the constitutional term of the parliamentary session while the parliament continues its work without justification, as well as bias through the absence of members from sessions of the council and its parliamentary committees. We have also addressed these cases from the perspective of legislative and constitutional texts, and reinforced them with the established judicial principles established by the Constitutional Court, which have contributed to addressing these cases. | ||
