Abstract
This study aims to examine the Islamic legal ruling on physicians’ fees and the costs of treating one’s wife in light of Islamic jurisprudence and Iraqi law. The concept of the legal obligation to cover a wife’s medical expenses has evolved alongside social development and changes in the cultures of European and Arab societies, as well as the multiplicity of social and legal perspectives in both contexts. This development has taken place amid the growing global interest in human rights in general and women’s rights in particular, as well as the mutual understanding and exchange of rights and responsibilities between spouses under the solemn marital covenant that binds them.
Islamic Sharia has established provisions and principles that safeguard human rights in various aspects of daily life and provide for their essential needs. The significance of this topic lies in the fact that Islamic Sharia has given due consideration to the rights of every human being, particularly those relating to the establishment and preservation of the family, and has prescribed specific legal provisions and regulations governing them.




Accordingly, the researcher seeks to examine human rights and family formation from the perspective of Islamic jurisprudence, and to clarify how Muslim jurists have addressed this issue, while comparing their approaches with the provisions of Iraqi law.
