| Abstract | ||
| In this study, we examined the legal system for practicing real estate development activities by examining the legal mechanism for granting the real estate developer a license to practice his real estate development activity in accordance with the laws, regulations and instructions in force, to be implemented in an organized manner with the help of comparative legislation and the experiences of developed countries, and then examining the obligations of the real estate developer Our study employs a descriptive and comparative analytical approach to Iraqi legislation and related comparative legislation. We primarily present the legal texts in comparative legislations regulating this field and then compare them with Iraqi laws. We will examine the legal framework for real estate development activities in two sections. The first section addresses the concept of real estate development and the licensing process for engaging in this activity. The second section examines the legal and contractual obligations of real estate developers. | ||
