Abstract
This research titled "Family Rights in Iraq in the Digital Age: Online Marriage Laws and Personal Rights Protection" addresses the concept of electronic marriage contracts, which are defined as agreements made using modern technology and are based on legal foundations that include the necessity of having the essential elements of the contract, such as offer and acceptance. The research demonstrates that electronic marriage contracts do not differ from traditional contracts in terms of their elements and conditions, but they possess a unique nature related to the electronic medium used, making the presence of the parties virtual. The study also discusses the components of electronic marriage contracts, detailing the processes of electronic offer and acceptance, highlighting how will expression occurs through digital means. It is evident from the study that there is an urgent need to develop a legal framework that regulates these contracts in line with technological advancements, thereby enhancing the protection of family rights and ensuring the stability of marital relationships within Iraqi society.
