| Abstract | ||
| It is well known that the legal regulation of personal status has a very serious importance because of its relation with the Variables concerning Human as Individual in a family. When the Personal Status Law of 1959 was passed, the Islamic jurisprudence appeared in the form of a written legal rules and it sole source is the legitimate provisions associated with the family, and then the article 41 of the Iraqi constitution in 2005 represented a serious development in the personal status rule for the Iraqis, and this lead us to study the thread studying the pros and cons and comparing that with the situation of the legal regulation of personal status before the constitution of 2005, especially in the framework of personal status law. | ||
