| Abstract | ||
| The latest period witnessed a revolution of scientific and technical developments in all fields, which has also been accompanied with the global financial crisis. In one sector, there was additionally a development in the legal field, in that a new type of criminality which was not there before emerged. And the sphere of this type expanded to an international shape, where the legislature in different countries stood unable to bridge the gap resultant from the expansion.. thus, our study is one of the topics that has not been studied since a long time. We felt it is necessary to illustrate the power of the foreign penal judgments before the Iraqi courts. Our study will also approach questions like, has the Iraqi legislature put the needed texts to facilitate for the courts the recognition of this power? What are the limits of this power? Do the judgments by the Iraqi courts and the foreign judgments have the same effect? And what have the comparative legislations arrived at in this respect? The explanation of these issues will make the legislature work to manipulate the shortage so as to build a criminal policy based on the international cooperation in combating crimes | ||
