| Considering the crime of bribery a private crime to official employee and charged public services there are two theory of legal nature for this crime the first consider this crime analysis into two crime the first one positive do it usufructuary which give it substitute to official implore second or promised on the two negative do it by official employee which take substitute on, the third theory one crime original efficient is the official employer , but briber consider partner of this crime . We support the first theory which adopt the doubles of crime bribe and this is the situation of the Iraqi legislator and this clear from the articles code penal dealing with the crime of bribe in six part in first section in the article ( 309-314) . | ||
