Abstract
The criminal arguments arise between two parties. The original party as represented by the public prosecution and the person who raises the lawsuit against him, as represented by the defendant.
Originally, the presence of public prosecution is a part of the forming of the court and its absence voids it. While the defendant must attain the session of the trail, and his INTE-NTIONALLY, absence without legal excuse made him subject to sanction. The scope of this sanction differs from statues to another. The French and Egyptian legislature expand the scope of the sanction that applied to the scope of the sanction that applied to the intentionally absence, while the Jordanian legislature limit the scope of the sanction.
This research aims to explain the rule of the defendant attain at the trail, and the sanction that will be applied for his absence.
